This privacy policy (“Policy”) informs you of our practices when handling your Personal Information through the Services (both as defined below). In this Policy, “Logipoly”, “we”, “us” or “Company” refers to Logipoly Yazılım ve Ticaret A.Ş., a company registered in Türkiye with its registered address located at Rüzgarlıbahçe Mahallesi, Şehit Sinan Eroğlu Caddesi No.6 AKEL İŞ MERKEZİ A Blok Kat: 1 34805 Beykoz - İstanbul. We are the data controller under the applicable privacy laws.


Where we have an enterprise service agreement in place with an enterprise customer who is asking you to use our Services (for example your employer), we obtain and process your Personal Information on behalf of and at the instructions of that customer. In that context, such enterprise customers are the data controllers and their privacy policies will apply to the processing of your Information. We encourage you to read their privacy policies.


For the purpose of this Policy, “Personal Information” means any information relating to an identified or identifiable individual. This includes Personal Information you provide or generate when you use: (a) Our Yukato Drivers app (the “App”); and (b), https://yukato.com/ website (the “Website”) (collectively, the “Services”). When you use the Services, you accept and understand that we collect, process, use, and store your Personal Information as described in this Policy.


  1. TYPES OF INFORMATION WE COLLECT


    We will collect and use the following Personal Information about you:


    Registration information you provide when you create an account with your registration account, such as your first name and surname, country of residence, date of birth, email address, phone number, username, and password;


    Location information, including precise or approximate location information provided by a mobile or other device interacting with one of our sites, applications, or associated with your IP address or other online or device identifier, where we are permitted by law to process this information and this information is not health data. In this application used for logistics tracking, the location data of the drivers is processed. However, this data is not health data in any way and health data is not processed in the application Instant location information of users (drivers) is processed for the purpose of using the application;


    Communication Information, when you contact us, you provide us with your phone number, email, and any other information you choose to provide over such communication, including information about your query.


    Drivers license information is collected to check driver qualification information within the scope of the service we offer with our application.


  2. METHOD AND LEGAL BASIS FOR COLLECTING YOUR PERSONAL DATA


    We collect information you provide to us when you request or purchase products, services, or information from us, register with us, or otherwise interact with us using one or more devices.


    Applicable law may require that you authorize the third party to share your information with us before we can acquire it.


    The personal data collected for the membership application are collected as part of the data recording system by non-automated or partially automated methods in electronic and/or physical environments in verbal/written form, non-automated or partially automated methods by the relevant person filling out the membership form via the mobile application or website or sharing it with our Company within the scope of the contractual relationship with our Company.


  3. HOW WE USE YOUR PERSONAL INFORMATION


    Personal data is used for the following purposes:


    Set up your account. We use your registration information, device information in order to set up an account for you to use our Services. We do so in accordance with our contractual and precontractual obligations to you in order to provide you with an account to use the Services.


    Provide you with the Services. We use your location information, usage information and platform information in order to provide you with the Services. In addition, we use your communication information to facilitate support (e.g. retrieval of a forgotten password). We do so in accordance with our contractual obligations to you in order to provide you with the Services.


    Communicate with you. If you contact us, we will use your contact information to communicate with you and, if applicable, your usage information to support your use of the Services.


    We may use your personal data in case of information and document requests from official authorities in order to fulfill our legal obligations. Detect, investigate and prevent activities that may violate our Policies, create security issues, or be fraudulent or illegal; and we will be able to use it to inform and notify you about security issues.


    Improve and monitor the Services. We use information we automatically collect or generate about you when you use the Services, as well as information about your device such as device manufacturer, model and operating system, and the amount of free space on your device, to analyze the use of and improve our Services.


  4. TRANSFERRING YOUR INFORMATION WITH OTHERS


    We will not share your personal information with a third party outside Logipoly except in limited circumstances, including:


    When you allow us to share your personal information with another company, by electing to share your personal information with carefully selected companies so that they can send you offers about their products and services;


    When you direct us to share your personal information with another company to fulfill your request, such as: You indicate to us that you are eligible for transportation involving goods or services provided by third-party partners, such as ground transportation providers, third-party logistics companies.


    When we work with service providers performing services on our behalf; however, these companies are prohibited from using your personal information for purposes other than those requested by us or required by law;


    When we share your personal information with third parties in connection with the sale of a business, to enforce our Terms and Conditions or rules, to ensure the safety and security of our guests and third parties, to protect our rights and property and the rights and property of our guests and third parties, to comply with legal process, or in other cases if we believe in good faith that disclosure is required by law.


    Please note that, except as otherwise stated above, once we share your personal information with another company in the above circumstances, the information received by the other company is controlled by that company and becomes subject to its privacy practices.


    When you choose to share with them through the Services, other users see your Personal Information (such as your username and email) and any other information.


    Law enforcement agencies, public authorities or other judicial bodies and organizations. We disclose Personal Information if we are legally required to do so, or if we have a good faith belief that such use is reasonably necessary to comply with a legal obligation, process or request; enforce our terms of service and other agreements, policies, and standards, including investigation of any potential violation thereof; detect, prevent or otherwise address security, fraud or technical issues; or protect the rights, property or safety of us, our users, a third party or the public as required or permitted by law.


    Please be aware that if you do not allow us to collect personal information from you, we may not be able to deliver certain experiences, products, and services to you, and some of our services may not be able to take account of your interests and preferences. If collection of personal information is mandatory, we will make that clear at the point of collection so that you can make an informed decision whether to participate.   5. RETENTION PERIODS FOR YOUR PERSONAL DATA AND DATA SECURITY


    We process and retain your personal data as long as required for the performance of our contractual obligation and compliance with legal obligations or other purposes pursued with the processing, i.e. for the duration of the entire business relationship (from the initiation, during the performance of the contract until it is terminated) as well as beyond this duration in accordance with legal retention and documentation obligations. Personal data may be retained for the period during which claims can be asserted against our company or insofar as we are otherwise legally obliged to do so or if legitimate business interests require further retention (e.g., for evidence and documentation purposes).


    The security, integrity, and confidentiality of your information are extremely important to us. We have implemented technical, administrative, and physical security measures that are designed to protect guest information from unauthorized access, disclosure, use, and modification. Our company maintains the necessary precautions regarding the security of your data at the highest level and is extremely sensitive about this issue. As soon as your personal data are no longer required for the above-mentioned purposes, they will be deleted or anonymized, to the extent possible.


  6. DATA PRIVACY PRINCIPLES


    Since we are a company located in Türkiye, we primarily comply with the Turkish legislation, Law No. 6698 on the Protection of Personal Data, and secondary regulations. Law No. 6698 is highly compatible with the legislation of the European Union and the relevant persons whose data are processed can exercise their rights in the same way.


    First of all, your data is processed in accordance with the basic principles of legal legislation in a limited and proportionate manner, in connection with the purpose. We will not process Personal Information in a way that is incompatible with these purposes unless subsequently authorized by you. We processes personal data in accordance with it is necessary to process personal data belonging to the parties to the contract, provided that it is directly related to the establishment or performance of a contract, the data controller must fulfil its legal obligation, data processing is mandatory for the establishment, exercise or protection of a right, data processing is compulsory for the legitimate interests of the data controller, provided that it does not violate the fundamental rights and freedoms of the data subject.


    If we intend to use your personal data for a purpose that is materially different from the purposes for which it was originally collected or subsequently authorized, or if we intend to disclose it to a third party acting as a data controller not previously identified, we will offer you the opportunity to opt out of such uses and/or disclosures where it involves nonsensitive information or opt in where sensitive information is involved.


    If we provide our Services in connection with an enterprise agreement, we may obtain and process EU, UK, and Swiss Personal Information on behalf of and at the instructions of our enterprise customers. In that context, such customers are the data controllers and we encourage you to read their privacy policies.


  7. YOUR RIGHTS


    In accordance with applicable laws you are entitled to:

    a- learn whether your personal data are being processed,

    b- if they are, request information,

    c- obtain information on the purpose of processing and find out whether personal data has been used as fit for the purpose

    d- obtain information about the third persons in Türkiye and abroad, to whom personal data are transferred,

    e- request rectification of personal data that may have been incompletely or inaccurately processed,

    f- request the deletion or destruction of personal data

    g- request notification of the operations made as per indents (e) and (f) to third parties to whom personal data have been transferred,

    h- object to occurrence of any detrimental result by means of analysis of personal data exclusively through automated systems and

    i- request compensation for the damages due to unlawful processing of personal data.

    Our Company shall fulfil relevant person’s requests as soon as possible and within thirty days at the latest and your initial request, depending on the nature of your request, shall be fulfilled free of charge. However, fees may be charged for subsequent requests on the same issue or if the initial request requires performance of a transaction for an additional cost. Our Company may accept and process the request or may reject by indicating the reasons in writing.


    You are entitled to file a complaint to the Turkish Board of Personal Data Protection (“Board”) within thirty days as of the notification of the reply and in all cases within sixty days if the application is rejected after carrying out the procedure mentioned above, the reply is deemed to be insufficient or the requests are not responded in a timely manner. However, the complaint cannot be filed without exhausting this application process.


    The Board may conduct the necessary inspections within its field of duty upon receiving a complaint or ex officio upon detecting a breach. The complaint shall be examined by the Board and answers shall be provided to those concerned. If no replies are given within sixty days as of the date of the complaint, the request shall be deemed to be rejected. If, as a result of inspections upon receiving a complaint or ex officio investigation, a breach is detected, the Board shall rule the identified contraventions of law to be eliminated by the data controller, and shall notify those concerned accordingly. This decision shall be fulfilled without delay but no later than within thirty days as of the notification of the decision. The Board is authorized to halt data processing or international transfer of data if damages that are hard or impossible to compensate occur and if there is an explicit infringement of the law.


  8. CHILDREN


    The Service and website are not targeted at children, and we do not knowingly collect Personal Information from children under the age of 18. If you learn that a child has provided us with Personal Information in violation of this Policy, please contact us as indicated below.


  9. CONTACT & COMPLAINTS


    For inquiries or complaints regarding this Policy, please first contact us at gdpr@yukato.com we will endeavor to deal with your complaint as soon as possible. This is without prejudice to your right to launch a claim with a data protection authority.


  10. CHANGES


    We may change this privacy policy to accommodate new technologies, industry practices, regulatory requirements or for other purposes. Where required, we will update this Policy from time to time. When we do so, we will make it available on this page and indicate the date of the latest revision. Please check this page frequently to see any updates or changes to this Policy.
