YUKATO DRIVER MEMBERSHIP PRIVACY NOTICE
Pursuant to the Personal Data Protection Law No. 6698 (“Law”), this Driver Membership Privacy Notice (“Privacy Notice”) has been prepared by Logipoly Yazılım ve Ticaret A.Ş. (“Logipoly” or the “Company”), acting as the data controller, to inform you regarding the processing of your personal data in connection with your registration as a driver on the Yukato mobile application (“Yukato”), your use of your driver account, and your participation in logistics operations carried out through Yukato.

In connection with the use of Yukato, your personal data may be processed by Logipoly in its capacity as either data controller or data processor, depending on the nature of the relevant personal data processing activity.
In this context, Logipoly acts as the data controller in respect of personal data processing activities for which it determines the purposes and means of processing, such as creating and managing your Yukato driver membership and user account, ensuring secure access to your account, carrying out user and account verification processes, ensuring the security of Yukato, conducting user support processes, and evaluating requests and applications submitted to Logipoly.
However, within the scope of transportation, shipment, delivery and goods acceptance processes carried out through Yukato, the purposes and essential elements of personal data processing activities relating to the creation and assignment of work orders to drivers, association of drivers with the relevant logistics operations, tracking of active operations and location data, management of information and documents relating to transportation and delivery, and coordination among the parties to the operation are determined, depending on the nature of the relevant operation, by the sender, recipient and/or logistics/transportation companies. In respect of such activities, Logipoly provides the technical infrastructure of Yukato and processes personal data as a data processor on behalf of, and in accordance with the instructions of, the relevant data controller companies.
Accordingly, among the personal data processing activities set out in the table below, activities relating to the management of Yukato membership and the user account, ensuring user and account security, conducting user support processes, and fulfilling Logipoly’s own legal obligations are carried out by Logipoly in its capacity as data controller; whereas activities relating to the creation, execution, tracking and completion of logistics operations are carried out in the capacity of data processor on behalf of the relevant sender, recipient and/or logistics/transportation companies.
Your personal data is processed on the basis of the following personal data processing conditions set forth under Article 5 of the Law:
The personal data processing conditions specified below constitute the legal grounds relied upon by Logipoly in respect of personal data processing activities carried out by Logipoly in its capacity as data controller and, in respect of personal data processing activities relating to logistics operations for which Logipoly acts as data processor, the legal grounds relied upon by the relevant data controller companies.

You may register with Yukato directly as a driver, or you may be invited to Yukato by a company with which you work. If you are invited by a company, your name, surname and mobile phone number are transmitted to Yukato by the relevant company, and an SMS notifying you of your invitation to Yukato is sent to your mobile phone number. In either case, you download Yukato to your mobile device and personally complete your driver registration and create your driver account.
Through Yukato, you may be assigned as a driver by the companies with which you work for transportation and shipment activities, or you may undertake a manoeuvring assignment for a specific address or operation; such assignments are managed through your existing driver account.
Within the scope of logistics operations carried out through Yukato, the relevant sender, recipient and/or logistics/transportation companies view and process your personal data through Yukato in their capacity as data controllers, while Logipoly acts as a data processor on behalf of the relevant companies in respect of these activities.
The table below sets out both the personal data accessible through Yukato by the relevant data controllers within this scope and the transfers of personal data carried out by Logipoly in its capacity as data controller pursuant to Articles 8 and 9 of the Law.

Once a work order is created through Yukato, your name, surname and mobile phone number may be viewed through Yukato by the sender of the relevant operation and, where applicable, the logistics/transportation company. If you accept the work order, such information may also be viewed by the recipient of the relevant operation. Once you commence the relevant transportation operation and grant the necessary location access permission through your mobile device, your location data relating to the active operation may also be viewed, together with your name, surname and mobile phone number, by the sender, recipient and, where applicable, the logistics/transportation company involved in the relevant operation. Such information is viewed for the purposes of tracking the shipment and transportation process, planning and carrying out delivery and goods acceptance processes, and communicating with you for operational purposes where necessary.
Your personal data is collected electronically by automatic or partially automatic means through your registration with Yukato as a driver, your entry of information into Yukato and use of your account, your invitation to Yukato by a company with which you work or your addition to the system as a driver by the relevant company, your acceptance of work orders assigned to you and performance of logistics operations, device permissions you provide to Yukato through your mobile device, records generated through Yukato during the performance of logistics operations, documents you upload to Yukato, and your communications with our Company.
Granting permissions for access to location, camera, photos/albums or notifications through the operating system of your mobile device enables Yukato to technically access the relevant device feature. Such device permissions do not, by themselves, constitute explicit consent to the processing of your personal data within the meaning of the Law; your personal data is processed on the basis of the relevant personal data processing conditions specified above.
You may at any time submit your requests under Article 11 of the Law regarding your personal data processed by us to the addresses below, in accordance with the Communiqué on the Procedures and Principles of Application to the Data Controller, in writing or by using your registered electronic mail (KEP) address, secure electronic signature, mobile signature, or the e-mail address previously notified by you to us and registered in our systems.
